Wi-Lan has suffered defeat in its patents trial against Alcatel Lucent, Ericsson, HTC and Sony, as a Texas court decided that the firms did not infringe its patents.
Wi-Lan filed a lawsuit against Alcatel Lucent, Ericsson, HTC and Sony in 2010 claiming the firms infringed patents that relate to data transmission over wireless networks. However a Texas court ruled that the four firms did not infringe Wi-Lan’s patents and found one patent Wi-Lan asserted against HTC and two it asserted against Alcatel Lucent invalid.
Wi-Lan had asserted that Alcatel Lucent and Ericsson infringed three patents, none of which claims were upheld by the court. The firm also asserted that HTC and Sony infringed another patent, and there the court not only judged against infringement but invalidated the patent.
Alcatel Lucent and HTC both said that Wi-Lan was trying to stretch its patents to cover technology in their devices.
Sally Julien, a spokeswoman for HTC said, “HTC believes that Wi-Lan has exaggerated the scope of its patent in order to extract unwarranted licensing royalties from entities who have been focused on bringing innovation forward in their own products.”
Kurt Steinert, an Alcatel Lucent spokesman said, “We think this validates our belief that Wi-Lan was stretching the boundaries of its patents, and the jury confirmed that belief.”
Wi-Lan has managed to get several companies to license its technology including Dell and Panasonic, and in May it initiated legal proceedings against Blackberry over a patent relating to Long Term Evolution network technology. However in this case the firm did not prevail against two large telecom equipment companies and two big smartphone makers.
Xen Project To Support ARMv8
Xen Project will release the Xen 4.3 hypervisor later today with support for ARMv7 and ARMv8 hardware.
The Xen Project overseen by The Linux Foundation produces an open source hypervisor that is a popular alternative to KVM. The project will release the Xen 4.3 hypervisor today with support for ARM servers, performance improvements and a technology preview of Open Vswitch.
The Xen Project is backed by a number of big firms including AMD, Cisco, Google, Intel and Samsung, and is one of the first hypervisors to support ARMv8 based processors along with the ARMv7 architecture. The Xen Project said it has been working with ARM server vendor Calxeda to validate Xen 4.3 on its ARMv7 and ARMv8 servers.
For the Xen Project, ARM server support, in particular ARMv8 support, will be key as servers using the architecture start to appear later this year and in volume during 2014. Given that Amazon Web Services, arguably the biggest cloud service provider around, is supporting the Xen Project, ARMv8 support in the hypervisor could be painful for VMware as it tries to compete against a free, industry supported alternative.
Lars Kurth, community manager for the Xen Project said, “The ARM server support is an exciting development for the community and we’re excited about the opportunities this will bring to customers.”
Xen 4.3 also includes improvements to power efficiency by using the MWAIT extension for processors such as Intel’s Sandy Bridge, Ivy Bridge and Haswell.
Linux Foundation VP and COO Mike Woster talked up the importance of virtualisation to the Linux and open source community. He said, “Virtualization is important to Linux and the open source community and the Xen Project is helping companies realize new levels of scalability and efficiency in areas such as cloud computing.
“With the latest release of Xen Project, organizations can advance their cloud computing strategies to deliver on customer expectations for their enterprise environments.”
The Xen 4.3 hypervisor was released yesterday.
MS Office Demand Fizzles
After a promising start, downloads of Microsoft’s free Office for the iPhone quickly nosedived, as the latest data from a mobile app analytics company showed.
But at least 200,000 copies of the small suite — iPhone versions of Word, Excel and PowerPoint — were downloaded in the first six days.
Distimo, a Dutch firm that tracks app store market data for several platforms, including Apple’s iOS, Google’s Android, and Microsoft’s Windows 8 and Windows Phone, said Office Mobile for the iPhone debuted in the No. 10 spot on June 15, the day after Microsoft launched the free app.
That was Office Mobile’s peak: On June 16, Office Mobile slipped to the No. 19 position among all free iPhone apps, then continued to slide throughout the week of June 17-23, starting that seven-day stretch at No. 36, falling to No. 86 by Friday, June 21, and ending at No. 299 on June 23.
From June 24 to July 6, Office Mobile was not on Distimo’s leaderboard, which lists only the top 400 downloaded apps.
The number of downloads of Office Mobile for iPhone is unknown — Distimo requires a paid account to show developers the estimated downloads of their apps and those of competitors, and did not reply to questions Sunday — but the tally was probably significant.
According to Distimo, to place in the App Store’s No. 10 spot, an app must average 72,000 downloads daily. Office Mobile was ranked No. 10 on June 15. Apps ranked at No. 50 averaged 23,000 downloads daily: Office Mobile held position at No. 50 or lower for five consecutive days.
Those numbers implied that at least 200,000 copies of Office Mobile were downloaded in the six days between June 15 and June 20.
Likewise, the sharp decline of Office Mobile’s position in the App Store’s free list after just a week hints at a pent-up demand that was quickly satisfied.
Although rumors of Office on iOS had circulated since the iPad’s 2010 introduction, they heated up last November when reports claimed Microsoft would launch a mobile version of the suite this year and tie the software to Office 365. At the time, most analysts agreed that Office 365 was the smart move because it could boost interest in the subscription concept Microsoft has bet will result in more, and more regular, revenue from its Office cash cow.
Linking Office on iOS to Office 365 would also let Microsoft avoid the Apple “tax,” the 30% cut that Apple takes from all App Store sales.
Only Office 365 subscribers can use Office Mobile. Subscriptions range from the consumer-grade Office 365 Home Premium, which costs $100 annually, to several business plans that start at $150 per user per year and climb to $264 per user per year.
Oracle Changing Berkeley
Oracle has changed the license of its embedded database library, Berkeley DB. The software is widely used as a key-value store within other applications and historically used an OSI-approved strong copyleft license which was similar to the GPL.
Under that license, distributing software that embedded Berkeley DB involved also providing “information on how to obtain complete source code for the DB software and any accompanying software that uses the DB software.”
Now future versions of Berkeley DB use the GNU Affero General Public License (AGPL). This says “your modified version must prominently offer all users interacting with it remotely through a computer network … an opportunity to receive the Corresponding Source of your version.”
This will cause some problems for Web developers using Berkeley DB for local storage. Compliance has not really been an issue because they never “redistributed” the source of their Web apps.Now they will have to make sure their whole Web app is compliant with the AGPL and make full corresponding source to their Web application available.
They also need to ensure the full app has compatible licensing. Practically that means that the whole source code has to be licensed under the GPLv3 or the AGPL.

Yahoo announced on Wednesday that it bought Qwiki for an undisclosed sum, as the firm’s spending spree continues.
Qwiki started out as a video focused search engine in 2011, before making its way into the iTunes Store as an app that turns images and videos into digital story boards.
Yahoo announced its acquisition of Qwiki on Wednesday, although it kept quiet about what it plans to do with the company and how much it spent. However, according to Allthingsd, Yahoo spent approximately $50m to further expand its digital offerings.
What’s more, while it’s unclear what Yahoo’s plans are at present, it’s likely that the firm is looking to challenge Vine and Instagram in the social video market.
Yahoo announced the news, naturally, on Tumblr. It said, “We’re excited to announce that Yahoo acquired Qwiki – a company that uses awesome technology to bring together pictures, music and video to capture the art of storytelling.
“We will continue to support the Qwiki app, and the team will join Yahoo in our New York city office to reimagine Yahoo’s storytelling experience. Stay tuned … there’s much more to come!”
Qwiki also had something to say, posting on its website, “Thank you for being a part of our story – one which is far from over. The Qwiki app will live on as a standalone entity inside Yahoo, where we will grow our thriving community and where our team will continue to work to help you share life’s best experiences.
“We are proud of the work we’ve done, and humbled by unwavering support from the NY tech community. New York is such a big part of who we are, and what we will become.”
Yahoo’s buyout of Qwiki is the latest in a series of acquisitions by the firm. Recently the firm announced that it bought Tumblr for a cool $1.1bn, with Yahoo CEO Marissa Mayer promising “not to screw it up”.
Intel Releases 16GB Xeon Phi
Intel has announced five Xeon Phi accelerators including a high density add-in card while upping memory capacity to 16GB.
Intel has managed to get its Xeon Phi accelerator cards to power the Tianhe-2 cluster to the summit of the Top 500 list, however the firm isn’t waiting around to bring out new products. At the International Supercomputing show, Intel extended its Xeon Phi range with five new products, all of which have more than one TFLOPS double precision floating point performance, and the Xeon Phi 7120P and 7120X cards, which have 16GB of GDDR5 memory.
Intel’s Xeon Phi 7120P and 7120X cards have peak double precision floating point performance of over 1.2 TFLOPS, with 352GB/s bandwidth to the 16GB of GDDR5 memory. The firm also updated its more modest Xeon Phi 3100 series with the 3120P and 3120A cards, both with more than one TFLOPS of double precision floating point performance and 6GB of GDDR5 memory with bandwidth of 240GB/s.
Intel has also brought out the Xeon Phi 5120D, a high density card that uses mini PCI-Express slots. The firm said that the Xeon Phi 5120D card offers double precision floating point performance of more than one TFLOPS and 8GB of GDDR5 memory with bandwidth greater than 300GB/s.
That Intel is concentrating on double precision floating point performance with its Xeon Phi accelerators highlights the firm’s focus on research rather than graphics rendering or workstation tasks. However the firm’s ability to pack 16GB into its Xeon Phi 7100 series cards is arguably the most important development, as larger locally addressable memory means higher resolution simulations.
Intel clearly seems to believe that there is significant money to be made in the high performance PC market, and despite early reservations from industry observers the firm seems to be ramping up its Xeon Phi range at a rate that will start to give rival GPGPU accelerator designer Nvidia cause for concern.
nVidia’s CUDA 5.5 Available
Nvidia has made its CUDA 5.5 release candidate supporting ARM based processors available for download.
Nvidia has been aggressively pushing its CUDA programming language as a way for developers to exploit the floating point performance of its GPUs. Now the firm has announced the availability of a CUDA 5.5 release candidate, the first version of the language that supports ARM based processors.
Aside from ARM support, Nvidia has improved supported Hyper-Q support and now allows developers to have MPI workload prioritisation. The firm also touted improved performance analysis and improved performance for cross-compilation on x86 processors.
Ian Buck, GM of GPU Computing Software at Nvidia said, “Since developers started using CUDA in 2006, successive generations of better, exponentially faster CUDA GPUs have dramatically boosted the performance of applications on x86-based systems. With support for ARM, the new CUDA release gives developers tremendous flexibility to quickly and easily add GPU acceleration to applications on the broadest range of next-generation HPC platforms.”
Nvidia’s support for ARM processors in CUDA 5.5 is an indication that it will release CUDA enabled Tegra processors in the near future. However outside of the firm’s own Tegra processors, CUDA support is largely useless, as almost all other chip designers have chosen OpenCL as the programming language for their GPUs.
Nvidia did not say when it will release CUDA 5.5, but in the meantime the firm’s release candidate supports Windows, Mac OS X and just about every major Linux distribution.

Last week Intel officially released Haswell, but there’s still life in good old Ivy Bridge. The chipmaker has announced a range of low-end Ivy parts and even a Sandy Bridge based Celeron.
The Celeron G470 is possibly the last consumer Sandy Bridge we will ever see. It is a single-core 35W part clocked at 2GHz and it’s priced at just $37.
However, Ivy Bridge parts are a bit more interesting. They include the Celeron 1017, a dual-core, dua-thread chip clocked at 1.6GHz, with a TDP of just 17W. It costs $86 and should be a nice part for low-end laptops and nettops. The Celeron 1005M also costs $86, but it has a 35W TDP and a 1.9GHz clock.
There are four new G2000 Pentiums as well. The G2140 and G2030 are 55W parts, clocked at 3GHz and 3.3GHz respectively. The G2120T and G2030T are 35W chips, clocked at 2.6GHz and 2.7GHz. They cost $64 and $75 respectively. Of course, Pentiums don’t feature Hyperthreading and all four of them are dual-core parts.
The Core i3 line-up also got some speed bumps. The Core i3-3245 and 3250 are clocked at 3.4 and 3.5GHz and both have a TDP of 55W. The 3245 features HD 4000 graphics and costs $134, while the 3250 ends up with HD 2500 graphics and a price tag of $138. Lastly, the Core i3-3250T is a 3GHz part with a 35W TDP, it costs $138, just like its 55W sibling.

Apple Inc increased prices of iPads and iPods in Japan on Friday, becoming the highest-profile brand to join a growing list of foreign companies asking Japanese consumers to pay more as a weakening yen squeezes profit.
Some U.S. companies have inoculated themselves at least temporarily against the yen’s fall through financial hedging instruments, while others are charging customers more.
The yen has fallen more than 20 percent against the U.S. dollar since mid-November when then-opposition leader Shinzo Abe, who is now prime minister, prescribed a dose of radical monetary easing to reverse years of sliding consumer prices as part of a deflation-fighting policy, dubbed “Abenomics.”
The Bank of Japan, under a new Abe-backed governor, in April promised to inject $1.4 trillion into the economy in less than two years to achieve 2 percent inflation in roughly two years.
Price rises are rare in Japan, which has suffered 15 years of low-grade deflation. A few other foreign brands have also raised prices on products, providing an early sign of inflation for Abe and an indication that these companies feel consumer demand is strong enough to withstand the increases.
Still, price rises would have to spread much more widely, especially to lower-end discretionary goods, to show that Abe’s aggressive policies are helping reinvigorate the economy.
Apple, one of the most visible foreign companies in Japan, raised the price of iPads by up to 13,000 yen ($130) at its local stores. The 64-gigabyte iPad will now cost 69,800 yen, up from 58,800 yen a day ago, an Apple store employee said. The 128-gigabyte model will cost 79,800 yen compared with 66,800 yen.
Apple also upped prices of its iPod music players by as much as 6,000 yen and its iPad Mini by 8,000 yen.

Judging from the number of people engrossed in activities with their smartphones on the sidewalk, in their cars and in public places, mobile seems to have stolen our attention away from the wired Internet and traditional TV.
However, there is a ways to go before mobile platforms become the primary place where consumers turn for entertainment and getting things done, players at CTIA Wireless trade show said.
Nokia Siemens Networks announced new capabilities in its network software to make video streams run more smoothly over mobile networks. Among other things, the enhancements can reduce video stalling by 90 percent, according to the company. But even Sandro Tavares, head of marketing for NSN’s Mobile Core business, sees “mobile-first” viewing habits as part of the future.
“Now that the networks are providing a better capacity, a better experience with mobile broadband, mobile-first will come,” Tavares said. “Because the experiences they have with the devices are so good, these devices … start to be their preferred screen, their first screen.
“This is a trend, and this is something that will not change,” Tavares said. But he thinks it’s too early to build networks assuming consumers will turn to tablets and phones as their primary sources of entertainment. “Do you have to be prepared for mobile-first now? Probably not. You have to be able to keep the pace.”
For AT&T, mobile-first is a top priority for its own internal apps, ensuring employees can do their jobs wherever they are, said Kris Rinne, the carrier’s senior vice president of network technologies. But to make it possible over the network, a range of new technologies and relationships may have to come together, she said.
For example, giving the best possible performance for streaming video and other uses of mobile may require steering traffic to the right network if both cellular and Wi-Fi are available. AT&T is developing an “intelligent network selection” capability to do this, Rinne said. When AT&T starts to deliver voice over LTE, it will stay on the cellular network — at least in the early days — because the carrier has more control over quality of service on that system, she said.
Other issues raised by mobile-first include security of packets going over the air and rights for content that subscribers are consuming primarily on mobile devices instead of through TV and other traditional channels, Rinne said.
